Just a “head’s up” client advisory….

As reported earlier, I attended the U.S. Civil Rights Commission open hearing last Friday–December 7–in Washington, D.C. to weigh in on the new U.S. Equal Employment Opportunity Commission (“EEOC”)  Guidance regarding the use of criminal background checks during the hiring process. The EEOC has taken the position that many practices currently used by employers are in violation of Title VII of the Civil Rights Act of 1964 as applied to Hispanics and Blacks…The U.S Civil Rights Commission has taken up this matter and will issue a position statement shortly.

This is a critical issue for our clients–and others–who presently use criminal background checks to defeat claims of negligent hiring.
